Nintendo has sent word it has prevailed in getting the United States Court of Appeals for the Federal Circuit to uphold the firm’s victory in a patent-infringement case brought against it by IA Labs CA, LLC. The Court of Appeals agreed with the lower court that Nintendo did not infringe IA Labs’ patent, and it upheld the ruling that IA Labs must pay Nintendo more than $236,000 in attorneys’ fees. “We are very pleased with the court’s decision,” said Richard Medway, NoAs deputy general counsel. “Nintendo has a long history of developing innovative products while respecting the intellectual property rights of others. We also vigorously defend patent lawsuits, like the IA Labs lawsuit, when we firmly believe that we have not infringed another party’s patent.”

The Witcher 2 is being updated considerably with a new patch. Among the large list of changed, additions and the like, you will see balances to combat, new animations and and a myriad of other things. Fallout 4, as we figured, wasn’t shown during E3 by Bethesda last week. According to a statement given to Kotaku on the matter: “We showed three games at E3 – Wolfenstein: The New Order, The Elder Scrolls Online and The Evil Within. We did not show any of our games behind closed doors,” said a company representative. Hopefully, you didn’t overdose on the salt over the weekend.

Kabam’s Fast & Furious 6 game, a free-to-play title for smartphones and tablets has been installed over 17 million times since its May 16 launch. Splinter Cell: Blacklist is getting an iOS game which will star the Spider-Bots which are in the game, running around gathering intelligence. The app is now available free on the App Store, and is a 2D puzzler where you control your spider-bot as it gathers intel and try avoiding other robotic spies, guards, and turrets. Grasshopper Manufacture CEO Goichi Suda has said he’s “always up to the idea” of creating another No More Heroes game. Speaking with Joystiq, Suda 51 said: “Travis [Touchdown] is one of the characters I’m really fond of, that means a lot to me. So if there was the opportunity to create another sequel then yeah, I’m always up to the idea.” Until then, fans can appease themselves with Killer is Dead on PS3 and Xbox 360 in August.

SEGA and Relic have extended the Company of Heroes 2 beta to June 23. The extension will add multiplayer maps into the rotation as well as double XP this weekend in auto match multiplayer modes, reports Joystiq. All general experience will transfer over to the game when it launches June 25. Players will need to purchase the game within 60 days of launch to keep their experience.

World of Tanks Update 8.6 is now available in Europe and will roll out to the rest of the world later this month. Southeast Asia will see the update go live on June 20, while American and South Korean players will get the update on June 25 and July 4, respectively. The latest update brings further changes and balance to the in-game economy, as well as adds new SPGs to Tier X. Along with the new artillery units, Update 8.6 also adds a new premium British tank, the A33 Excelsior, as well as a new battle arena-Sacred Valley, based on a Korean setting. A video is below.

Donkey Kong Country Returns 3D topped the Media Create charts in Japan with 104,569 units moved, and ultimately helped provide 3DS with a much needed surge after disappointed hardware sales over the last couple of weeks. Sales of 3DS LL hit 29,533 units over the prior week’s 27,172 units, while 3DS sales saw the biggest jump out of the two offerings. The system moved 17,602 compared to 12,700 the prior week.
