Exclusive: Courtney Love’s attorney responds to use of Cobain in Guitar Hero 5

VG247 has received an official statement from Courtney Love’s attorney, Keith Fink, Esquire, regarding Activision’s use of Kurt Cobain’s likeness in Guitar Hero 5.
Apparently, like we assumed, she is upset over Cobain being used to play other artists’ songs, which she finds detrimental to his image and legacy.
“You are correct in stating that Ms. Cobain is extremely upset at Activision’s use of Mr. Cobain’s image in a video game allowing him to sing songs of others,” Mr. Fink told VG247. “Kurt’s songs have a unique and special meaning to his fans and his image and legacy is extremely important to Ms. Cobain.
“Activision’s statement is not accurate in suggesting that they were given an unfettered use of Kurt’s name and likeness. The agreement Activision has with the trust doesn’t grant them the right to use his name and likeness in ways that denigrate his image.
“We are demanding the trust take appropriate action to protect Mr. Cobain’s image and would hope Activision would do so on its own accord and prohibit users of the game from singing songs of others.”
We have a feeling this is far from over, and you can catch up on all that happened yesterday through here, and here.

Interesting turn of events, Courtney might actually have a solid case against them, lets see what Acti says.

“denigrate his image” – Activision couldn’t do any worse than Cobain managed himself, abandoning his little girl by taking the easy route out of his troubles.
The other Nirvana members have weighed in the GH5 issue too – http://xbox.boomtown.net/en_uk/articles/art.view.php?id=18567

This is getting ridiculous. Can anyone explain to me exactly how having Cobain sing other people’s songs “denigrates his image”? Are Bon Jovi or Public Enemy songs sooo inferior to Nirvana songs that Kurt cannot be associated with them? And to be pedantic, have they (the trust) *specifically* prevented this from happening (in which case they have a leg to stand on) or are they clutching at straws here?
They should have refrained from selling the rights to his likeness in the first place…

Well, having him shout Flava-Flav’s catchphrase is rather vulgar. Anyone shouting that phrase would be vulgar. I hope Johnny Cash doesn’t do it.
Also @ Harry. Not saying that suicide is a wonderful thing, but you honestly cannot condemn someone for something like that when you have no idea what was going on in their lives. No, it is not a good thing, and yes it is considered the “coward’s way out”, but sometimes people see nothing but a dark hole sucking them in and there is no way out. Add heroin or recovering from it into the mix and it is 1000 times worse. Fame, fortune, fans, drugs, and not being able to leave the house without being mobbed has taken its toll on some of the best in the music industry, and Hollywierd as well – he was no exception. Just because you seem to have “everything” doesn’t mean that you actually do.

Having seen the YouTube compilation video I can really see where the complaints are coming from. I can’t imagine Kurt himself would have ever agreed to such a thing. Does Johnny Cash do all that stuff as well? It’s really quite an astonishing thing for Activision to do – I can’t believe anyone agreed to it.

It would be like having John Bonham’s likeness playing drums along to a Backstreet Boys tune. /vomits at the thought

Does anyone even care who their avatar is when they play GH?
I mean you spend all your time looking at the rolling fretboard anyway, so who gives a shit if it’s Kurt Cobain or a wireframe model with a tennis racket?
I think most people would prefer a character creation kit anyway (do they have that now? I haven’t actually played GH since 2)

*snip* Deleted most of my post because no matter what one has been through the net is full of people who’ll take the piss.
You make an excellent point about Bonzo though. I might have to burn the game if that happened.

You have people mobbing your house too 24/7 do tell?
Sorry but morales, right and wrong or in the eye of the beholder. Not some set writings in stone.

Yes, Cash is also a playable character in all the songs and it’s just as tasteless.

Wise decision Harry (although having read your initial post, there was nothing wrong with it).

Apparently, Courtney never intended to sign off on it.

But she did obviously. Activision wouldn’t let this out if it didn’t recieve the signature and a recall very unlikey. Activision will be paying her a lump sum, the damage is done.

I just find it somewhat ironic that this is happening when arguably one of Nirvana’s most critically acclaimed albums happens to be mostly covers (see Nirvana MTV Unplugged).

Its not fucking degrading, the man is dead, nobody cars if he’s singing The Touch by Stan Bush or Smells like Teen Spirit.

Cobain was never really into fakery, ever see the Nirvana performance on TOTP where they told them they could sing live but would have to mime their instruments?

He does a fucking Morrissey impression for fuck sake! I don’t think he’d give permission for this to go ahead if he was alive, and Courtney Love shouldn’t be in charge of his estate if she’s signing shit without knowing what it actually is she’s signing away.

Its Cobain’s anti-comericialist ghost coming back for vengeance :-p
