GOING LOCO: Hacker Hotz feels heat, hides in South America

According to Sony, Geohot, the hacker currently being sued by the firm for publishing PS3′s root key earlier this year, has fled the US as an “excuse” for not turning over hard drives as per a court order.

A document filed by Sony in the case has claimed that Hotz is now in South America, and is now presumably smoking some kind of giant blunt in a parrot-filled, jungle castle.

“After Magistrate Judge Spero ordered an inspection of Hotz’s devices and ordered Hotz to appear at a deposition in California, SCEA learned that Hotz had deliberately removed integral components of his impounded hard drives prior to delivering them to a third party neutral and that Hotz is now in South America, an excuse for why he will not immediately provide the components of his hard drives as requested by the neutral.

“Hotz’s attempts to dodge this Court’s authority raise very serious questions.”

Sony, to employ British colloquial vernacular, appears to be “right up George’s ass”. The company is also claiming Hotz lied to the court about owning a PSN account.

“On January 12, 2011, Hotz submitted a declaration to the Court (Docket No. 19-1) in which he made unequivocal statements on a number of topics. However, when it came to discussing the PSN account, Hotz equivocated, stating: ‘To the best of my knowledge and belief, I do not have a PlayStation Network account.’

“Hotz also provided interrogatory responses that he has refused to verify, stating that he has not accessed the PSN.

“Hotz identified four PS3 Systems in his possession. He explained that he had purchased one of these consoles new in February 2010 and provided the serial number for that console. SCEA used that serial number to determine that on February 25, 2010, Hotz purchased the PS3 System at a Gamestop store just miles from his home.

“SCEA’s records show that the same PS3 System was used on March 10, 2010 to create a PSN account under the user name ‘blickmanic.’ The IP address associated with the registration is located in Glen Rock, New Jersey, where Hotz lives.”

Lawyers for Hotz, who is now apparently venturing into the mythical realm of actual anti-corporate renegade super-ninja, recently accused Sony of “material misrepresentations” related to claims over whether it’s SCE or SCEJ that owns the rights to PS3′s SDK.

This isn’t looking good for George. As well as access to GeoHot’s drives, Sony has been granted the details of his PayPal account and the IP addresses of visitors to his website.

Hotz has claimed the drives must not be searched, because they contain commercial material which could prove financially disastrous.

Get a backpack, a GPS phone and a machete, get into the rainforest and work on your defence from there, George. Don’t let them take you alive.

    Though to be honest, Sony should be slapped against the face for going this far against someone who is little more than a kid. The fact that he has done a runner is because he’s probably fucking scared and to far out of his depth to have a massive company trying to chuck him in jail or fine him millions of dollars before he’s even had a real chance to earn an honest penny in his life.

    Honestly unless Geo has kiddie porn on his HDD, Sony is going to look like they are bullying him around. In my mind, if not GeoHotz, then someone else. Sony publicly claimed their system was unhackable. Thats like a challange to hackers. Someone would have cracked it.

    I feel, at this point that Sony is going to destroy the kid trying to make him a scapegoat.

    I think he did runned away because theres something else on his drives, that scare the hell out of him, maybe is related with this case, maybe dont, who knows, well at least he have the money he did rise from donations, at least he can live with for a short period of time, the only ones being f**ked up by this are the lawyers, me thinks they are not gonna get paid after all.

    I’m not saying Sony shouldn’t do anything, they have to protect their IP and security, but trying to make an example of someone who is little more than a kid is going too far.

    @TEA, In the UK, most of those ‘user agreements’ mean shit so I barely read them because most of what they state are illegal or my rights from the UK and Europe supersede them. Sony are just abusing their legal power to save face and are more than happy to ruin this kids life instead of just trying to get him warned/set straight.

    As for the MS case (typing M$ makes you a tool btw) I don’t know anything about that. Got a link?

    Both examples of corperate greed Tea. Both ugly. But, what will Sony gain from persuing Hotz? Lest MS was facing being counter sued in civil court for fruad. Sony faces … nothing. I wouldn’t be proud of either move if I was either company.

    And Crysis can you show us how Sony lost million due to GeoHotz actions?

    Gotta consider both Wii and xb360 have been wide open for a long time. Both of those systems sell pretty well if ya ask me.

    See the thing about piracy that needs to be understood is that pirates don’t buy games. I have a brother inlaw that has a Wii cracked. He has about every VC game on it. And a handfull full blow Wii games, nope I don’t know how – but seen it. He does the samething with his iPhone. But don’t ever think for a second that he would have bought those games had he not had someone mod them for him.

    Thats the way of it. Don’t buy into the corperate crap trap that claims that each and every game pirated is a lost sale.

    I understand that companies need to protect their own. Thats where the security comes in. And yes it will get cracked. But not like those cracks are going to be on sale at your local Game store.

    Depends where you live. In HK R4 cards for the NDS are freely available in shopping centres. Shops will also happily mod your PSP and provide a memory stick with games on for a fee. It’s been driven a little more underground in recent years – 4 years ago you could get them in major malls, about a year ago it was more the smaller less flash shopping areas you needed to go to.

    I do agree with the general sentiment that estimates of losses are overblown by corporations though.

    While I’m not anyone’s side on this matter – the things I find amusing are that
    1) People treat him like a kid. He’s turning 22 which can’t get you car insurance with great ease (because young males are the greatest liability for obvious reasons) but should be relatively mature to not want to desperately want attention unless you’re a c/z list celeb wannabe.
    2)He obviously had planned on bailing the country which is why he sought paypal donations and then closed them saying he hit the required amount. I don’t think he actually hit any target for actual legal fees but just wanted money to pretty much bail. Exchange rates aren’t too bad now are they?
    3)Both sides of the actual case have a lot of issues, yet people take sides.
    4)Every discussion about this will ultimately end up with Godwin’s law proved over and over simply because of the Nazi connotations to running to South America.
    5)What sort of lawyers would he have had? I mean right now the biggest crime he’s committed in a legal sense would be tampering with evidence. Seriously that’s just extremely stupid. Unless of course there was something there that was far more incriminating.

    As for the amount of xbox360 gamers that claim their PS3s are shit thing. I think thats a bit goofed up. Take a look:

    If a gamer owns both systems and picks the one they like more, how is that somehow bad? How is that “wrong” choice? I mean they did buy the PS3 in the first place. I was Very excited when I brought my first PS3 home. But that excitment went away over time. I wanted to like it more, enjoy it more, play it more.

    I didn’t buy it to hate on it, it was expensive afterall.

    Also I think it is silly to think that because I play on xb360 that I want to hurt PS3. Again, I spent a fair amount on it.

    Lets say I did(I wouldn’t of course) pirate every game on PS3. How much sales would Sony lose over that?

    Zero. Why? Because I wouldn’t have bought those games anyways. I do, btw buy PS3 games now and then. Just saying.

    I have a hard time believing that anyone who would buy a PS3 just to use a hack and pirate games wouldn’t also do the samething with a Wii and a XB360. I also doubt that such a person would have bought games for either of those systems in the first place.

    I mean we can debate the moral and even legal matters surrounding this until the cows come home, but the fact is, it was always beyond stupid to behave and act the way Hotz has done, whilst having his real identity known.

    As much of a massive dick as I think he is, I’m saddened that somebody with the technical ability of Hotz has quite possibly ruined his life over this. As I understand it, he’s now guilty of tampering with evidence, which means he’s proper (jail time) fucked, regardless of the case Sony were/are building against him. Also, I wonder how much of the donation money he requested has gone into funding his getaway?

    I’m genuinely off into town now to pick up a copy of Romancing The Stone, so cheers for that at least. :)

    Look, this whole thing is sonys fault, for not putting enough gray matter on which applications should came since launch with the equipment, without damaging the consumers, an electronic device like all things in the world evolve,in order to have more applications, not less like this case, if you took an application out of a device that you promoted since launch day, that will be fully supported during its lifetime , is deceiving consumers,as soon as sony did realize the big mistake they made, they should opt for the non-damaging consumers choice, sony should solve it without tooking said application (OtherS). period, this thing gave an excuse, so is there fault for not launching, a very expensive one by the way, a console with all the pros and cons list.

    O.G. it clearly states that if you violate the user agreement you will be prosecuted to the full extent of the law. So why can’t people find its the right thing SONY are doing. Word gets around fast now that social networks have taken off. Everyone and their grandmother knows about the exploit and many have used it.

    It doesn’t matter if you steal a dime or a dollar from me O.G. I would still consider you a thief and my enemy and the feeling would be mutual if it we’re vice versa. For all those people you claim may have hacked the PS3 from the beginning who’s not to say all those random PS3 updates weren’t targeted for them secretly. Think about that….     That won’t happen as he has now turned tail and fled the country. The courts if anything will dismiss the case because defendant is simply not there or it will go right to Sony which to me seems like Sony is aiming for publicly humiliating this kid which they have done so especially with him going to South America because of things on his HD.

    This whole things is terribly wrong. I am sure many more ppl viewed his sites and were interested in the hack from around the world than there were in califronia. Also, why is the case already taking place in california when the jurisdiction hasnt even been shown to belong there? Why is it a california judge that gets to rule on whats been going on so far and why is it a california judge that decides whether its a california case or not? Should it not be taking place in the more obvious location of where hotz lives?

    I think that is 100% true. Sometimes it isn’t always about right and wrong. Esp when the publics focus is going to be on the meassured response.

    And Sony never had high credibility, remember the PSone launch and turning your systems upside down to get them to read games? And thats just one stain. Most, prolly all of the bigger corperations have a long list of people they stepped all over.

    No one is going to be able to change Hotz, or the thousands of others just like him. All Sony is responsible for and will be judged for is how they handle the situation.

    That’s Islamic law. Its a religious belief that we have no control over and I won’t consider that the same as this matter with Hotz. What is wrong with you dude seriously?     Ohhh ok he’s a poor decision maker but not a bad guy. He should have stayed anonymous and still released the exploit to the world and in that case he would have been a hero in your book.     This isn’t a movie O.G. this isn’t Catch Me If You Can. The guy broke the law and now he’s fled the country because he knows what he did was wrong. Hell he might have even committed other crimes for all we know whats on those HDD’s.     Things to take note of:
    the hack never made piracy directly possible. In order to pirate a game you had to make an app that allowed for piracy using the key that was discovered and published.
    At that point you are breaking the law and being immorral. Neither Hotz nor the other hackers ever made such a piece of software.

    Jail breaking computers you own is common these days. In the case of the iPhone it was even found to be totally legal.

    Sure, Hotz acts like an asshole, but that isn’t against the law either.

    In any event the way some people paint him out to be some kind of mass murderer (or equal to one) is fairly absurd.
    Pretty much every piece of hardware out there has been cracked open, it doesn’t matter.

    Actutally, a big reason why so many people bought the PS3 was because they had the promise of OtherOS and the ability to install Linux on it. Sony said that they would never remove it as it was a big selling point of the console, but then decided to patch it out citing security concerns but never revealing what those security concerns where ( at least to my knowledge anyway).

    Part of the reason why the PS3 has been hammered on the recent hacks is because of this. So many consoles where bricked because of the update and a lot of people who were running Linux on it where pissed that Sony had bricked their consoles. I’m pretty sure this was in, in part, a response by Hotz to this. Not keeping up on this, so can’t be 100%.

    Now Sony are being sued in one of the Nordic countries (sweden I think), because changing the terms so it removes a selling point is illegal in that country, and since they didn’t offer any recompense to those who bought it to install Linux on is a big kick in the teeth.

    If i committed a hit and run. The cops caught up to me and i was proven guilty, you think they would slap a sticker on my back that says “Stupid, don’t break the law” and send me on my way…No, i would get 2yrs in jail and be charged $10,000.
    If i was caught speeding, do i get a ticket that says “Please be nice and think of others first”? No. I get a ticket, a court date, and get charged $500.

    This guy, hacked Sony’s security, which they pay lots of money to have protected under the law, and then shared the know how to the world over the internet. Its one thing to mod your own console, its another to exploit its entire security measure and share with the whole world for people to fuck with.
    He is fleeing in order to save himself the consequences of the actions he committed without thinking first. Sony isn’t ruining his life and they aren’t forcing him to run and hide. He took the matters lightly, laughed/spit in Sony’s face, and his arrogance made him blind to the possibilities that he might be held accountable for his actions for his actions.

    For the record, I don’t care who wins or loses this battle. I couldn’t care less. But, for any of you to defend a person who clearly broke the law, spat in the face of the company that financed this law, and then proceeded to gloat about it all over the internet, is laughable.

If that was truly his intended purpose in the matter, it could have been done to just that extent instead of releasing the entire root key to the general public.

    #86 with all due respect, do you know which were his true intentions, his intended purposes?, i think no one can, but one can assume that if his intentions were piracy, for example, he can also divulge the applications needed to do so, but no, he only divulge the key to open it.

    Like i said it before this whole thing is sonys fault, for not putting enough gray matter on which applications should came since launch with the ps3; An electronic device like all things in the world, evolve, therefore to do so the manufactures put more applications on said devices, not less and/or taking them like this case, if you took an application out of a device that you promoted since launch day and one that will be fully supported during its lifetime cycle , is not other thing than deceiving the consumers, as soon as sony did realize the big mistake they made, they should opt for the non-damaging consumers choice, sony should solve it without tooking said application (OtherS). period, this thing gave an excuse (and a right one if you ask me), so is their fault for not launching a console, a very expensive one by the way, without doing all the pros and cons list, that was such a big misscues for a big multi million dollar corporation.

    So for me what Geo Did was foolish, because he did made the thing public by his name, and not anonymusly, and what sony did (took away other s), without any compensation whatsoever to consumer, was indeed wrong,this of course in the eyes of the consumers(myself included), you may agree or not, but it was plain and simple wrong.

    I think it would be a great idea if Sony releases the PS4 with Google Chrome OS preinstalled & the NGP with Android preinstalled, Given Sony’s & Google’s relationship that doesn’t seem out of the question, but I really, REALLY doubt the NGP will get official Android support, but it’ll definitely be hacked to down the line given it’s phone-like architecture.

    I never said it was right, and I also said I wasn’t 100% sure. What I do know is that the PS3 wasn’t really attacked until Sony removed the ability to install Linux. After that it got hammered. Sure, people where trying to find ways around the Hypervisor but with only limited success on a software level. Other people took to the soldering iron route to try and break it on a hardware level, but with very limited success.

    Hotz got the ‘master key’, but he stupidly put his name against it when he posted it to the world. I’m not saying what he done was right, but Sony have turned this into a witchhunt. The people who are really to blame for this, in my eyes, are sony themselves. If you remove a selling point of a console, brick thousands of consoles and force them back to 3.50 or whatever the update was, and then don’t offer any compensation is going to the communities back up. That is what Sony has done. I know several people who only bought the PS3 to install Linux, only to have that option forcibly removed from them without Sony saying why its been removed.

    No, jailbreaking your equipment is not only for piracy. There are many legitimate uses that often expand the capability beyond the manufacturers specifications.
    Cool interface hacks for the iPhone, emulation (as has been mentioned here), homebrew software. And excelent almost proffesional level software like the XBMC mod for the original Xbox. It turned it into a great multimedia machine, better even then the official Windows media server. And still better then the Xbox 360 can do today.
