Report – Bethesda drops Interplay lawsuit [UPDATE]

Update: Well, apparently, the proceedings are not over. According to Peter Hines, it’s “still ongoing and has not been resolved. It is a minor procedural thing that took place, not a dropping of the lawsuit.”
“The bottom line is it’s an ongoing legal matter, it’s in no way, shape or form done,” Hines continued. “We’re going to let the process play out in the courts, which is what we’ve said all along, but beyond that I can’t give specifics as to procedures. That’s not my domain.” (via Kotaku)

US judge denies Bethesda’s injunction against Interplay

US District Court judge Deborah K. Chasanow has denied Bethesda’s motion for an injunction against Interplay over licensing for the Fallout MMO its working on, and the Fallout Trilogy containing Fallout, Fallout 2, and Fallout Tactics.
For now, at least, Interplay will be able to continue selling the bundle and the individual games, as well as continue to work on the MMO (Project V13) due to the licensing deal forged between the two companies during 2007 , in which Bethesda purchased the franchise for $5.75 million.
Bethesda filed suit against Interplay earlier in the year not only over the Fallout MMO, but claiming that the Trilogy pack would confuse consumers into thinking it was Fallout 3.

Rumor: First in-game screens for V13 surface

What is being claimed as the first official in-game screenshots for Interplay’s Fallout MMO, Project V13, are over on The Vault Wiki.
The site says it received the shots form an anonymous source, which it fails to name due to the current court battle between Bethesda and Interplay.

Court battle between Interplay and Bethesda still ongoing

Looks as though the court dealings between Interplay and Bethesda over the Fallout MMO are not over just yet.
According to a post on Interplay’s forums, the firm’s in-house has said that a hearing in the case is still “weeks away”.

You will not often hear from me, but as Interplay’s in-house lawyer I feel the need to set the record straight here…
The Court has not ruled on Bethesda’s Motion for Prelminary Injunction. A proposed order was filed with our Opposition to the Motion, but that is not the same as an Order of the Court. The hearing is weeks away. Interplay will issue an official statement if there is a material development that needs to be addressed. Please do not rely on rumor or speculation.
In the meantime, we all appreciate your enthusiasm and support.

Bethesda to sue Interplay over Fallout MMO

Bethesda has filed a lawsuit against Interplay for trademark infringement, and breach of agreement over the Fallout MMO.
Citing failure to “commence full scale development by April 4, 2009 and to secure certain funding for the game”, Interplay has disputed the claims and maintains that it still holds the rights to develop Project V13 with Masthead Studios.
This lawsuit comes months later after Bethesda challenged Interplay’s rights to the game back in April, when Interplay was actively seeking financing or income, without which it will be forced to liquidate assets, sell the company or face bankruptcy.
On a brighter note, Natiq “Defonten” Aghayev, Project V13 concept artist and Fallout fan community member, has released a bit of his concept sketches done for the game, which is featured in the header image.

Fallout MMO confirmed, is codenamed “Project V13″
Interplay has confirmed that the Fallout MMO it talked about earlier this year is underway, and that it has an internal codename of Project V13.
The info comes from the company’s new site. Click on the “new offices” button to see for yourself.
Interplay had previously said it was seeking funds for the project: looks as though it found some.
