Take-Two Duke Nukem Forever lawsuit includes Xbox 360 ports and off-shore bank accounts

Gather ’round, kids. It’s story time. Shacknews recently couldn’t avoid stumbling over new documents pertaining to the Take-Two and 3D Realms’ Duke Nukem Forever feud because — hoo boy — within those documents lies one tall tale.
In essence, Take-Two claims that 3D Realms/Apogee wouldn’t agree to develop an Xbox 360 version of the now debatably deceased game, so Take-Two began searching for another developer to get Duke ready for his Xbox 360 close-up. This, of course, meant that 3D Realms would have to provide source code for the outsourced port.
However, that assured screaming match between Take-Two and 3D Realms never even had a chance to occur, because 3D Realms then imploded, taking DNF’s source code with it. Thus, Take-Two sued 3D Realms, since — according to the “agreement” Take-Two hasn’t been seen without since this whole thing began — 3D Realms was obligated to provide source code for the project.
Here’s where things take a turn for the outlandish, though. Take-Two believes 3D Realms has more money than it’s been letting on, claiming said secret mattress stuffed with cash is hidden in an “off-shore account.”
“Upon information and belief, Apogee has title to a substantial amount of funds deposited in an off-shore account, which Take-Two believes Apogee can use to fund its outstanding obligations,” reads the suit.
The Duke developer, of course, says the allegation is rubbish.
“3DR has been in nearly a dozen lawsuits (including against Warner and Fox). We’re always innocent, and we always win. This one is no exception. Give it a year, then the truth will come out,” said 3D Realms/Apogee founder Scott Miller.

id thought Nukem canning was a “joke”

id biz man Steve Nix told VG at E3 that he thought news of Duke Nukem Forever’s cancellation was some kind of internet fabrication.
“I thought it was a joke when I heard the other day,” he said. “Definitely extremely saddened and surprising that those guys aren’t there and we may never see the game we were all looking forward to.”
Forever became the most ironically named game in all history in May when 3DRealms abandoned the project after 12 years due to a lack of funds.

3D Realms “has not closed and is not closing”

3D Realms has just issued a statement saying the firm is an ongoing concern and has not closed.
It was widely reported that the developer bit the dust earlier in May thanks to a lack of funding.
“Despite rumors and statements to the contrary, 3D Realms (3DR) has not closed and is not closing,” said the firm.
“3DR retains ownership of the Duke Nukem franchise. Due to lack of funding, however, we are saddened to confirm that we let the Duke Nukem Forever (DNF) development team go on May 6th, while we regroup as a company.
“While 3DR is a much smaller studio now, we will continue to operate as a company and continue to license and co-create games based upon the Duke Nukem franchise.”
3DR has also responded to a lawsuit filed against it by Take-Two, which said the publisher was out of pocket to the tune of $12 million over Forever.
“Take-Two never paid 3DR advances or any signing bonus or any other funds related to DNF, up until July 2008, at which time they paid $2.5m in connection with another agreement for an unannounced game,” the statement read.
“This is the sum total Take-Two has paid 3DR in connection with DNF.”

Miller: We never saw T2′s $12 million

3D Realms boss Scott Miller’s said the developer never saw the $12 million Take-Two’s claiming was dropped on the failed development of Duke Nukem Forever.
“No. We didn’t get a penny of that money,” said the exec, talking in this Shacknews comments thread.
“This, along with so much else, is 100 percent spin, being eaten up by those who have no clue whatsoever.”
Take-Two claims that it is owed “millions of dollars” by 3D Realms for breaking an agreement to finish the game.
The publisher also requested a copy of the existing Duke Nukem Forever source and object code “to ensure the code is preserved and remains unharmed during the pendency of this lawsuit.”

Take-Two sues Apogee over Nukem delays

Take-Two’s filed a suit against Apogee for continually delaying Duke Nukem Forever.
The publisher is now $12 million to the bad after 3D Realms went bust, Forever never being delivered.
“Apogee continually delayed the completion date for the Duke Nukem Forever,” Take-Two said in the complaint.
“Apogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version of the Duke Nukem Forever.”

Rumour: DNF footage leaked

3D Realms being done and dusted, there’s not much holding back Duke Nukem Forever assets seeping out. As you can see after the break.
It’s not confirmed as coming from the game, but it clearly is. It comes from ex-3D Realms employee Bryan Brewer’s personal website.

Duke Nukem Forever artist releases never-before-seen shots of game

Duke Nukem Forever artist, Chris Smith, has released some shots of the title over on his personal blog.
Stating on the page that he is currently looking for work now that 3D Realms has gone bust, Smith wrote nothing but positive things about his experience on the project.
“Two years, nine months. Now it’s over. It was fun while it lasted. I worked with an extraordinary bunch of artists, designers, and programmers. You will all be missed.”
The previously unreleased shots of the game are also posted over on D’toid.

Duke Nukem Forever hits development milestone

3D Realms George Broussard said on Twitter today that a developmental milestone has been reached on the long-awaited Duke Nukem Forever.
According to the tweet, the firm has cleared off a large percentage of the game’s original goals – and Broussard likes the show “24″:
“71 more tasks to do and we started with probably 800-900.”
Further:
“Heading home. Got some music for the game and commented. Have a couple more things to close out tomorrow for milestone. 24 is on!!!”
While the information is still a bit esoteric, we can only hope it means we’re about to see something other than Christmas wallpaper from the game.

3D Realms has made up a nice piece of Duke Nukem Forever wallpaper for Christmas – get it in various sizes from the developer’s site.

First hands-on with Duke Nukem 3D XBLA
Shacknews has posted what’s apparently the first hands-on with the XBLA version of Duke Nukem 3D. From the piece:
Trading in keyboard and mouse for trigger and analog stick, I was relieved to see how well it’s held up. It’s still an enjoyable FPS, an innovative game that even today is worth playing for the first time. To have it ported to the smoothest multiplayer platform in the business, and updated with new features and bonus content, will be a real treat for Duke virgins and veterans alike.

Duke Nukem 3D to have saved films, rewind feature
A Microsoft represntative told Joystiq at X08 in Toronto that Duke Nukem 3D, released on XBLA sometime in September, will have saved film and gameplay rewind features.
The rewind feature lets you do just that: rewind the game to a previous area where you messed up or simply think you can do things better. The save feature is self-explanatory too: take saved films from multiplayer matches and share them with your friends on XBL.
So there you go.

Duke Nukem XBLA finished, released “soon”
3D Realms’ George Broussard has told Shacknews that Duke Nukem XBLA is finished and will be released “soon.”
“We officially passed final cert on our first try Friday, August 15th,” said Bruossard.
When asked about price, he said: “about what you’d expect.” So anywhere between 800 and 1200 Points, we’d imagine.
According to the official site, the game is now in the hands of Microsoft.

3D Realms: E3 “Irrelevant,” tiny screenshots are only way to go
When asked by Next-Gen why Duke Nukem Forever won’t be making the trip to E3, 3D Realms chief Scott Miller had a pretty straightforward answer.
“We view E3 as irrelevant nowadays,” he said. “In fact, I wasn’t even aware it was coming up.”
We suppose that would be an issue when you’re developing your game under a rock. Never fear, though. Everything’s still on track.
“Development is swimming along nicely,” Miller added. “Seriously nicely.”

Duke Nukem Forever not going to E3
Well strike us pink and call us Shirley. According to this Voodoo Extreme post, 3D Realms isn’t going to show Duke Nukem Forever at E3 this year. Did anyone expect otherwise?

Update: It’s true. We just watched it. It’s a nice looking shooter with a shrink ray. And a worm with teeth. It’s embedded after the link.
Or is was posted. Apparently this Jace Hall movie contained the first ever in-game footage of Duke Nukem Forever, but has not either been pulled or is having bandwidth issues.
According to the site: “Jace Hall lands an exclusive interview with George Broussard and Scott Miller of 3D Realms. He even gets to play Duke Nukem Forever, the game that’s been in development for over 12 years – and Jace has the footage to prove it!”
Plenty of the posters in this Evil Avatar thread saw it before it went tits up, so we’re keeping the faith that it did actually happen.
Hopefully someone’s nicked it and we can have a look this evening.

Shacknews shown Duke Nukem Forever
Shacknews has been to 3D Realms’ offices to actually, properly view Duke Nukem Forever, as you can see here.
We actually got to see the truth of Duke curator George Broussard’s many past claims, including environmental puzzles and interactivity, a host of finished weapons, the existence of an in-game forklift, and plenty of heads and arms being blown off.
We both confidently agree that after seeing this demonstration, Duke Nukem Forever is looking great, and will easily stand apart from the crowd in both visual and gameplay styles.
You pretty much have to read that, so off you go. No release date as yet. We kill ourselves.
