3D Realms suing Gearbox over unpaid Duke Nukem Forever royalties

3D Realms has filed a suit against Gearbox Software over unpaid Duke Nukem Forever royalties. The breach of contract suit was filed in Texas on Friday, June 7 with the claim that Gearbox didn’t pay out all the monies stipulated in the purchase agreement between the two companies signed back in 2010.

3D Realms also claim Gearbox has blocked an independent audit of the royalties.

“3D Realms has therefore been required to file this lawsuit to enforce the purchase agreement, to recover the amounts due and owing from Gearbox and to enforce the audit right provided by the agreement to enable it to conduct an audit of Gearbox’s royalties,” the complaint read.

Gearbox has denied the allegations: “The reality is that 3D Realms received the full benefit of its bargain. Gearbox, in fulfillment of its commitments, enriched 3D Realms, saved 3DR from its debts and rescued 3DR from its failed dozen plus year attempt to ship Duke Nukem Forever.

“Everyone wished that 3DR’s game was better received by the market for the benefit of gamers and profit to its creators. While 3DR might not wish the reality that the results make clear, 3DR turned out to be the only beneficiary of the deal. Gearbox Software, meanwhile, experienced damage to its credibility and loss of its money.”

    On the one hand, 3D Realms is speaking legalese and Gearbox is taking a PR position, which makes me guess that 3D Realms is probably in the legal right.

    On the other hand, it’s depressing to be reminded that 3D Realms’ primary source of income is milking royalties from a game in the mid ’90s.

    Really!? 3D Realms took 10 year+ to make a Duke Nukem game, nothing materialised, Gearbox ACTUALLY made the game, without Gearbox this game still wouldn’t of existed and 3D realms would still throw money down the shitter, fucking plebs.

    @5 But if GB never gave them that coffee, or even worse, gave them a cup of Mellow Birds (which frankly has no right to be called coffee), then they still have a case!

    I love the Borderlands franchise, but with every passing day GB seem to be digging themselves into a deeper hole! Between the whole Colonial Marines saga and now this, if either have merit, I see some major personnel changes coming up in their near future.

    @7 works for me…but it would seem cheaper just to give them a free coupon for coffee and be done with it.

    I understand their point of view, but if you release crap, you should get crap in return. Crap is crap no matter what you look at it.
