Nintendo to pay royalties on every 3DS sold following patent dispute

An update in the long-running Nintendo vs Tomita Technology 3DS patent dispute has the platform holder shelling out a percentage of sales revenue on every 3DS unit sold.

According to Law360, in December Nintendo was ordered to pay Tomita 1.82% of the wholesale price of every 3DS sold - about $3.

The royalties must be paid for the lifetime of the console, which has already totted up 35 million sales worldwide.

The new royalties come in addition to a $15 million damages payment announced in August 2013, which Nintendo had ferociously battled down from an initial $30.2 million.

Nintendo was found guilty of infringing on Tomita's patented technology in early 2013 shortly after Tomita first sued, but the case has dragged out; the company first made its allegations in mid-2011.
