Colonial Marines lawsuit "without merit", "frivolous" say defendants

Gearbox Software and Sega have both issued dismissive statements regarding a class action lawsuit accusing the two companies of falsely advertising Aliens: Colonial Marines.

“Sega cannot comment on specifics of ongoing litigation, but we are confident that the lawsuit is without merit and we will defend it vigorously,” the publisher told Kotaku.

"Attempting to wring a class action lawsuit out of a demonstration is beyond meritless," Gearbox chimed in.

"We continue to support the game, and will defend the rights of entertainers to share their works-in-progress without fear of frivolous litigation."

The suit alleges that developer and publisher committed fraud in bringing an unrepresentative demo to trade shows. The disparities between the demo and the finished product are widely documented.
