38 Studios assets set for auction, 360 dev kits cannot be included says Microsoft

38 Studios' assets are being auctioned off, along with Xbox 360 developer kits which Microsoft hopes to reclaim.

Auctioneers at the SJ Corio Company will auction off the bankrupt studios' assets on October 16t in Maryland and on October 23 in Rhode Island.

Assets include: computers, printers, copiers, projectors, televisions, and other items.

The Xbox 360 XDK consoles, Microsoft says are not to be auctioned as they are the sole property of the company.

"Xbox 360 Development Kits (XDK) are the property of Microsoft and are only licensed to authorized studios and may not be assigned or sold to any third party without the written consent of Microsoft," Microsoft told Polygon.

"We will be contacting the appropriate parties involved in the auction of 38 Studios' assets to remove the XDK units from the auction listing and to secure the return of the consoles to Microsoft."
