Activision vs EA, West and Zampella case given the go head

After months of deadlock, a California Superior Court judge has ruled to move forward with Activision's $400 million suit against Infinity Ward founders Jason West and Vince Zampella.

Bloomberg reports EA must now defend itself against allegations that its relationship with West and Zampella prior to their dismissal from Activision amounts to industrial espionage.

EA's lawyers had argued against Activision's allegations by pointing out that the latter had not identified any points of confidential informational supposedly revealed by West and Zampella.

The judge concluded Activision had supplied sufficient evidence to go forward with the suit, although all other claims were overthrown.

Activision's case is a counter-suit to West and Zampella's claims for $36 million in unpaid bonuses relating to Call of Duty: Modern Warfare 2.
