Duke Nukem creator Apogee is suing current Gearbox Software over withheld profits from sales of panned shooter Duke Nukem Forever. The studio claims Gearbox has blocked attempts to carry out an audit on the game’s lifetime sales figures.

3D Realms suing Gearbox over unpaid Duke Nukem Forever royalties
3D Realms has filed a suit against Gearbox Software over unpaid Duke Nukem Forever royalties. The breach of contract suit was filed in Texas on Friday, June 7 with the claim that Gearbox didn’t pay out all the monies stipulated in the purchase agreement between the two companies signed back in 2010.

An intro video for Borderlands 2 DLC, Tiny Tina’s Assault on Dragon Keep, is posted below. Assault on Dragon Keep sees you playing as a Vault Hunter playing a game of Bunkers & Baddasses, a homage to Dungeons & Dragons with Tiny Tina as your dungeon master. Wicked. The content is the final DLC for Borderlands 2, will be out June 25. It will be free for season pass holders, or $9.99 or 800 Microsoft Points for those without a pass.

Aliens: Colonial Marines patch re-released on Steam after being pulled
Aliens: Colonial Marines received a patch yesterday from Gearbox Software on Steam, only to be pulled due to problems reported such as missing downloadable content and and not being able to use ini tweaks due to anti-cheating changes. Gearbox said it pulled the patch until it could figure out what was causing the corrupt DLC error, and later on in t he night it re-released the patch stating that the reported problems had been solved. The firm said on its forums it “continuing to work on updates for all platforms, including the hot fix support mentioned at PAX,” and that more details would be released once finalized. The patch which was re-released added a toggle for the film grain filter and increased security to address cheats and exploits.

Borderlands 2 update 1.40 adds Ultimate Vault Hunter difficulty, more
Borderlands 2 has been updated, and with it, comes: the new difficulty mode Ultimate Vault Hunter; new items for the Black Market; new upgrades to backpack storage; upgraded bank capacity; the usual bug fixes, plus some game and mission fixes. Borderlands 2 OS-X updated at last, on sale
Mac port developer Aspyr has advised that it has released an update for the OS-X version of Borderlands 2. The patch adds leaderboards, achievements and “more importantly, multiplayer co-op with their Game Center friends”. Hopefully that last one means the much-touted cross-platform compatibility with PC is also back, having vanished thanks to a Gearbox update to the Windows version last year. Aspyr has also made DLC available as in-game purchases, and is offering 50% off the shooter RPG sequel on the Mac App Store.

Aliens: Colonial Marines Wii U mysteriously delayed
Aliens: Colonial Marines still has not received a new released date for Wii U having missed a targeted March launch. A Sega representative simply told Gamespot that the publisher has no comment on the matter, and Gearbox and port developer Demiurge are also playing mum. The shooter attracted a great deal of attention at release due to its poor critical reception, and discrepancies between promotional materials and the final product have even drawn the wrath of the UK’s Advertising Standards Agency.
