Nope, you get your console banned for flashing your system to play pirate games, your gamerscore goes untouched and you can till use your LIVE account on any other 360.
For cheating (like hacking to get gamerscore) your score gets reset and your account is marked with "cheater" (or something like that).
So yeah, banned for playing pirate games, unpunished for cheating.

Reask a one year warranty on electronics is standard practice also you do know the failure on the PS3 is no where near that of the 360 right. Forget that little BBC episode you saw by watchdog. I thought I had this little talk with you before the other night. Now read carefully this time so you can learn something about "word of mouth"
If I buy something used from a big chain store that has to check and test the product out before they sell it as used they better stand behind their word. If it doesn't work and it fails then its the store's fault. If its working perfectly and M$ does an update that breaks it then its M$ fault. Many people buy 360's used because the one they bought RROD on them and they want another one asap. So they buy a used one and send the broken one in for repair. I'm still buying software for my used system regardless right?
So if they break my used 360 that I know nothing about being hacked don't they have an obligation to repair the damages. If word got around that M$ was unfairly doing this to customers who had no knowledge about their used system being hacked by its previous owner then I could see sales dropping a lot.
Stand by your product no matter what M$ and new and used have the same 64% failure rate so it doesn't matter.

If you buy a 360 from a person, and it's banned, you get your money back from the person. You make it sound like buying used has no risks, when in reality you don't have the slightest clue if what you're buying is 100% or not.
What you posted about regarding getting one whilst your machine is broken (you're really obsessed with that by the way, ignoring the fact that the latest revision is pretty much bulletproof) is irrelevant... because it's down to the seller to check. Where was your outrage when Sony and Nintendo bricked hacked machines with firmware updates? (PSP / Wii)
First: To use the psp and wii's network capabilities are free and so are the services. They're not paying a sub for a service like live. So they actually don't lose their money for a service they can't use unlike the XBOTS.
Second: the three year warranty is M$ fault in the first place...please have common sense to understand that and don't bring it up again.
Third: anybody who upgraded their PSP while it was hacked is a dumb ass for using official firmware. That's why torrents have custom firmware for PSP available. Sony couldn't just snap their fingers and go "BAM!" you're hacked PSP is now bricked. As for the wii, fuck them because there's no reason to even hack it for you to be playing it in the first place because it has no good games.

I'm done arguing though. Your stance on this is pretty clear, to the point that you're making excuses for others.
