Actually, I answered what you asked in my very first post >.> I said that they are not breaking the rights as during administration, they don't have to refund the products. I can't see what you aren't grasping here...

The bottom of the store reciept says they are being controlled by administrators and are unable to return goods currently.

However, now that this is all blown over you will definatly get a replacement from your local store as all services will resume next week I'm sure.

In theory, you should have been given a replacement for the sake of good customer service as this doesn't need to be put through their till system and if they took a controller out of a faulty returned console this is even less hassle as that machine would be going back to their DC anyway.

Anyway, the chestnut is; it's legal and it's PWC Administrators who called the shots.

Oh dear god nobody is answering the actual exact scenario..! Frustrating!

1, They ARE selling things DURING administration.
2, The goods bought DURING administration are non refundable!
3, They are NOT informing customers of #2

Consumer law is there to protect against this exact scenario, isn't it?

Actually they have every right, if you have full knowledge of that and still buy something, that's your fault. Also, seriously try replacing / refunding it when they're out of administration, they might do it then. As I said, they can refuse refunds during administration, any company can.

My case is different as I bought pre-administration. I mean it's wrong, but yes, they likely have loopholes for it. Congrats to them for losing a customer who has spent thousands over a £15 faulty gamepad.

Anyhooo.. the manager saying things bought DURING administration are non-refundable is what I strongly believe breaks the law. They surely have no right to be open / sell in the first place if they're saying that? Or at the very least they'd have to inform every customer purchasing goods that those goods have no in store warranty?

You really think that they'd get this far if it wasn't legal? Of course it is, there is a legal process of responsibilities and sadly, Johnny Customer with his random Gift Card / faulty £14.99 item is down on the priority list, don't blame GAME for this I'm sure if they had the operational funds, you'd get a gift card value / refund; they don't - you don't.

The staff are far more important in this respect, they need paying and since, it potentially could be their last paycheck I totally agree.

It blows my mind that something like this happens and all of a sudden every Tom, Dick & Harry turns into Perry Mason.

They can't refund anything during administration due to every Pound having to be accounted for, the store should have replaced it for you out of goodwill but that's all you're entitled to.

Don't worry, GAME have been bought so panic over, yes?

So many dodgy things happens when companies reach the peak of closing down, my dad's been screwed out of over $20'000 in two separate occasions where the businesses suddenly close their doors. I reckon that they may have been intentional too, they illegally withheld his money for several months then shut their doors making getting anything impossible.

And the people buying things during administration..?

I don't see how they can sell stuff if they have no intention of refunding/replacing faulty items.

If you paid by card (credit card rather than debit) then you talk to your CC issuer and they get the money back, otherwise there isn't a lot you can do. I know it sounds dodgy, but that's how administration works. You have to write a claim into the administrator saying they owe you £xx.xx and then if they have any money after paying everyone else then you might get something.

I did pay by card, though I don't see how that changes consumer rights for FAULTY products. Bringing something back cos you change your mind, I can see them deliberating over or changing the rules; sure. But for faulty goods?

They said they wouldn't redfund any faulty products that were being sold on the day. So Joe bloggs buys a PS3, gets it home, YLOD, tough luck?

No way is that legal.

Actually, if the stores / company is in administration, there is no automatic right that they have to accept the return, unless you paid by credit card or visa (which is called chargeback). So no, GAME are not breaking consumer law. You might be able to get a refund if GAME come out of administration, if you're lucky.

Long story short went to my store in MK and the manager told us they won't accept returns during administration. I bought an xbox pad 4 days prior, tis faulty, shoulder button doesn't work. Have receipt. Mate was with me, he asked if that means anyone buying goods today would be unable to return faulty products. Answer was yes.

This sounds dodgy as hell to me...
