The Banner Saga sequel blocked by King’s trademark claim

The Banner Saga developer Stoic has said it can’t fulfil its ambitions to make a sequel to the tactical RPG while King blocks its rights to the series’s title.

In a statement, Stoic said King’s trademark claim is interfering with its plans to make another game in the series.

“We won’t make a viking saga without the word Saga, and we don’t appreciate anyone telling us we can’t,” the developer said.

“King.com claims they’re not attempting to prevent us from using The Banner Saga, and yet their legal opposition to our trademark filing remains. We’re humbled by the outpouring of support and honoured to have others stand with us for the right to their own Saga. We just want to make great games.”

Stoic’s Alex Thomas told Polygon that the developer filed a trademark for The Banner Saga before King put in its own claims.

“They’ve blocked our trademark and extended the deadline for the opposition twice so that we are unable to have the rights to the name,” he said.

“Essentially, we are not allowed to own the name ‘The Banner Saga’ for our game about a viking epic, because King.com says they have claimed rights to the noun ‘saga,’ which means ‘a viking epic,’ forever more in the realm of games.”

King, the company behind Candy Crush Saga, said in a statement issued yesterday that it isn’t trying to stop Stoic from using the word “saga”, but has to go through the legal motions in order to prevent future issues – but a sequel to The Banner Saga falls into this category, apparently, since Stoic is prevented from using the title.

King has also trademarked the word “candy”, but promised that it would use the trademark thoughtfully, and not to patent troll. Developers have banded together to host a candy jam in protest.

    Someone needs to bring down King.com… somehow.. preferably permanently.

    I hope Stoic find a way around this travesty. Who ever decided you could legally trademark single words needs their heads caving in.

    @1: Trademarking single words is fine, but not words everybody uses, like SAGA. For christs sake, how can you sue something for something like that? That is just insane.

    Its a stupid trademark claim but whats so hard to change “The Banner Saga” into something else?

    New unknown Game Developer Studio (3 guys), unknown IP…just pick another name.

    Wont matter for the game and they can avoid stupid legal trouble.

    “We won’t make a viking saga without the word Saga” back to Kindergarten with them.

    @5 Name recognition is a humongous part of marketing, especially for a small company that doesn’t have much market penetration. Sometimes it’s all they have. So a sequel to a fairly popular game like The Banner Saga without the word Saga would be a HUGE hit to sales.

    @5 If they back down over something like this it sets precedent so if they change it to The Banner Story and some twat in a suit comes along and says ‘oi, we trademarked ‘Story’, you’ll have to change that.’ They will stand even less chance than now…

    I still don’t understand, how they manged to get their patent on Saga and Candy approved. Isn’t there any law that prevents this? I mean I remember back then when Sony actually had a Trademark on “Walkman” but it was used so frequently, that they lost the TM, since it became a word of common use (or somethig like that).

    Hm, I should file a a patent on.. “War”, “Duty” “Kill” “Death” “Space” “The” and some other nice words and tell People their games/movies/products can not have those words in them unless they give me 5% of their sellings.

    You have to wonder what the Hell is wrong with the US, giving People the possibility of doing shit like that.

    But seeing that the Game Scrolls is still called Scrolls tells me that Bethesda couldn’t stop them using that Word, so I hope this Kingdicks won’t do it better.
    I just want Part 2 of Banner Saga, need to know what happens next.
