In between its lawsuit with Bethesda over the rights to the IP, Interplay has released concept art of the Fallout MMO, which is still in development at the studio, despite the lawsuit.
“Keep in mind that this is concept art. It’s not finalized art, but it will give you a feel for what we are aiming for with V13,” said Interplay’s Chris Taylor.

And do Bethesda even have anything on the drawing board or are they just holding the concept in reserve?

Bathesda is not even working on it. Interplay is. bathesda is suing them because they had bought the rights from Interplay. Atleast thats how I understood it.
Honestly when has Interplay made a game in the last 10 years. I am surprised they are still going.

As I understood it Interplay retained (or thought they retained) the rights for the MMO, but now Bethesda wants them so to the court room they will go.

Bethesda is suing them because Interplay was supposed to have the MMO far into devlopment by now as well as procured full funding for the game and they haven’t done jack squat. oooo wow CONCEPT ART ! lol Bethesda doesn’t want these incompetent people ruining their brand really is what its all about from what I understand.

iirc, Bethesda bought the rights to the series and licensed them back to Interplay to make the MMO. However, there was a time limit attached to the rights which Interplay failed to meet, therefore the license was withdrawn and blah de blah de legal proceedings, etc.

Sounds to me like Interplay don’t have a leg to stand on at the moment. They should have settled this out of court, the legal costs will cripple them.

They’re probably going to ask that Bethesda pay their legal costs if they win. Though i’m pretty sure they wont, hope they lose to, i want my FO MMO!!
