Bethesda to sue Interplay over Fallout MMO

Friday, 11th September 2009 18:08 GMT By Stephany Nunneley

Bethesda has filed a lawsuit against Interplay for trademark infringement, and breach of agreement over the Fallout MMO.

Citing failure to “commence full scale development by April 4, 2009 and to secure certain funding for the game”, Interplay has disputed the claims and maintains that it still holds the rights to develop Project V13 with Masthead Studios.

This lawsuit comes months later after Bethesda challenged Interplay’s rights to the game back in April, when Interplay was actively seeking financing or income, without which it will be forced to liquidate assets, sell the company or face bankruptcy.

On a brighter note, Natiq “Defonten” Aghayev, Project V13 concept artist and Fallout fan community member, has released a bit of his concept sketches done for the game, which is featured in the header image.

More regarding all of this can be found over on, The Vault, which has a link to the legal documents filed.

I am absolutely sure FO will not happen, not because of Bethesda, but because Interplay will flop again.

Well it becomes a situation with Interplay, if they aren’t meeting milestones that means they aren’t getting paid, so then it becomes why even develop the game. As people don’t get their paycheck, they are leaving. Then it just becomes like a dog trying to chase their own tail.

This project will never see the light of day, its in development hell.

If I’m not mistaken Bethesda owns(be it all or partially)the rights to the Fallout franchise till 2013 which means we will probably see another Fallout game from them(most likely in 2013),I mean they didn’t buy those rights just to make a single game now did they.

It’s easy to renew the rights once you own them. Would be interesting if they do another Fallout with the Skyrim engine.
